Terms and Conditions

BY PARTICIPATING IN AND/OR USING OUR WEBSITE OR SERVICES, YOU ACKNOWLEDGE AND AGREE TO ALL TERMS CONTAINED IN THIS DOCUMENT AND IN OUR PRIVACY POLICY.

By completing a registration and participating in any Velocity Rally event, you (A) acknowledge and agree to all terms and conditions contained herein, and (B) agree to tender payment of the full registration fee.

1. Nature of the Event

VELOCITY RALLY IS NOT A RACE. Participants must not compete against one another in any manner, and wagering of any kind related to the rally is prohibited. All participants must drive safely, courteously, and defensively at all times, with full regard for other participants, fellow road users, and pedestrians.

No participant may operate a vehicle while their ability to do so is impaired in any way — including by illness, fatigue, alcohol, prescription or recreational drugs, or any other condition that could endanger themselves, other participants, the public, or property. Reckless driving, lane-cutting, shoulder-driving, tailgating, or any conduct that endangers others is strictly prohibited and may result in immediate removal from the event without refund.

2. Compliance with Laws

Each participant must comply with all applicable federal, state, county, and municipal laws at all times during the rally, including but not limited to traffic and speed laws, vehicle registration and safety requirements, licensing requirements, insurance requirements, and laws governing alcohol or controlled substances. Velocity Rally staff reserve the right to remove any participant from the event, without refund, for any violation of this section or of any other term in this agreement.

3. Event Logistics

Velocity Rally staff will provide event details and any credentials or badges required for participation. If issued, credentials must be worn or displayed at all times during the event.

The rally is open to a broad range of makes, models, and years, though the field will generally consist of distinctive, high-performance, classic, and exotic vehicles. Spots are limited, and acceptance is not guaranteed; preference is generally given to unique or noteworthy vehicles.

Unless explicitly stated otherwise in your registration, airfare, lodging, and vehicle transport are not included in the entry fee.

All drivers must be at least 21 years of age. Any passenger under 21 traveling in a participant's vehicle is the sole responsibility of that driver.

4. Limitation of Liability

Velocity Rally, together with its owners, employees, contractors, agents, staff, assigns, and attorneys, accepts no responsibility and shall not be liable to any participant for the consequences of that participant's own actions or omissions during the rally — including citations, charges, prosecution, or removal from the event resulting from a participant's conduct at any location, stop, venue, or public road during the event. No lodging is included unless specifically stated in writing.

5. Insurance

Each participant must obtain and maintain insurance appropriate to their participation in the rally and must provide proof of such coverage upon request by Velocity Rally staff. Appropriate coverage includes, at minimum, third-party liability, personal liability, medical coverage, property damage coverage, and coverage for the vehicle's participation in the rally.

Each participant must hold valid, unrestricted vehicle registration matching their name, and a current, valid driver's license, and must present either upon request.

6. Sobriety

Each participant must remain completely sober while operating a vehicle during the rally. Consuming alcohol while driving, or driving under the influence of alcohol or any other intoxicating substance, is strictly prohibited at all times.

7. Indemnification

You agree to indemnify Velocity Rally staff against any and all claims, lawsuits, or causes of action brought by a third party arising from the rally as a result of your actions, omissions, or participation — including any violation of law or breach of these terms.

8. Force Majeure

Velocity Rally is not responsible for failing to fulfill its obligations due to fire, earthquake, epidemic or pandemic illness, severe weather, flood, drought, strike, labor dispute, civil unrest, terrorism, or any other circumstance generally recognized as force majeure under the laws of the State of [Insert State].

If such an event prevents you from attending, you may attempt to sell your spot to another party; Velocity Rally is not responsible for facilitating that transfer, and any deposit paid will instead be applied as credit toward a future Velocity Rally event rather than refunded.

9. Event Branding

Participants agree to display the Velocity Rally logo, and any logos designated by Velocity Rally staff (including official sponsors), on their vehicle for the duration of the event. Logos may not be obscured or altered and must be kept visible and in good condition. Logos will be applied using materials that are readily removable without damaging vehicle finishes; Velocity Rally is not responsible for any damage resulting from their application or removal.

10. Sponsorship & Promotion

Official Velocity Rally sponsors may advertise to participants during the event. Personal sponsorship of a participant's vehicle or apparel requires prior written approval from Velocity Rally staff, which may be withheld at their sole discretion. Velocity Rally reserves the right to exclude any vehicle displaying unauthorized sponsorship from the event.

11. Refunds & Cancellations

Refunds. Once the rally has begun, no refund or compensation will be issued if a participant is unable to continue for any reason. The route may be demanding; failure to complete any portion of it, or to reach a scheduled venue, does not entitle the participant to a refund.

Velocity Rally reserves the right to refuse entry to, or cancel the participation of, any registrant at any time, for any reason. In such cases (outside of force majeure events, addressed above), the participant will receive credit toward a future event rather than a cash refund. Costs other than the entry fee remain the participant's responsibility.

Cancellation by a Participant. A participant who can no longer attend may resell their registration independently, for any price they choose. The new registrant must complete the standard registration process to be eligible to take the original participant's place, and payment for the transferred spot is handled directly between the two parties — Velocity Rally is not involved in or responsible for that transaction.

12. Media & Photography

By participating, you consent to being photographed and filmed as part of the rally's documentation. You waive any right of privacy or publicity with respect to such material and grant Velocity Rally a worldwide, perpetual license to use your name, image, likeness, and voice in connection with rally footage and promotional material. Velocity Rally retains sole discretion over whether and how such material is used or edited, and you release Velocity Rally from any claim — including invasion of privacy or defamation — arising from its use.

Participants may capture their own photos and video for personal, non-commercial use only. Publishing such material — on a website, in print, or on television — requires prior written consent from Velocity Rally staff. Participants may not arrange media appearances related to their participation without similar written consent.

Velocity Rally may update these terms from time to time and will make reasonable efforts to notify participants of material changes. Continued participation after such changes constitutes acceptance of the amended terms.

13. Governing Law

These terms, and any participant's involvement in the rally, are governed by the laws of the State of [Insert State], and any related dispute is subject to the exclusive jurisdiction of the courts of that state. By registering and participating, you are entering a legally binding agreement with Velocity Rally on these terms.

14. Risks of Participation

You acknowledge that participation in the rally is inherently dangerous and carries numerous risks, including but not limited to traffic accidents, collisions with other vehicles, pedestrians, or fixed objects, and the negligence of other drivers. Participation may result in serious injury or death to you or others. The route will involve public roadways with ordinary travel hazards, and may require extended periods of driving, potentially in adverse weather, demanding sustained physical and mental focus.

15. Assumption of Risk

With full knowledge of the risks described above, you voluntarily enter the rally and fully assume all risk of loss, damage, or injury, including death.

16. Compliance by Other Participants

You agree to comply with all terms of entry. Velocity Rally will make reasonable efforts to ensure that other participants do the same but cannot guarantee their compliance.

17. Release of Liability

In exchange for being permitted to participate, you waive, release, and forever discharge — on behalf of yourself, your heirs, executors, and legal representatives — any claim against Velocity Rally (and its officers, directors, employees, contractors, and agents) and event sponsors for any damages, injury, or death arising directly or indirectly from your participation, including the provision of emergency or medical care during the event, even where such damages, injury, or death result from the negligence of those parties. Nothing in this section limits liability for personal injury or death caused by gross negligence or intentional misconduct where such limitation is not permitted by law.

You further agree not to sue Velocity Rally or its sponsors for any such claim, including claims for personal injury, death, property damage, economic loss, breach of contract, lost wages, indemnity, contribution, or punitive damages, however arising from your participation.

18. Indemnity

You agree to defend, indemnify, and hold harmless Velocity Rally (and its officers, directors, employees, contractors, and agents), along with its sponsors, licensees, and assigns, from any claim, demand, damage, suit, or liability arising directly or indirectly from your actions or participation in the rally, whether asserted during or after the event, including associated legal costs and any settlement amounts.

By registering and participating, I certify that I have read and understood all of the above, and I agree to be bound by these terms and conditions.

BY PARTICIPATING IN OR USING OUR WEBSITE OR SERVICES, YOU ACKNOWLEDGE AND AGREE TO ALL TERMS BELOW.

Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of being permitted to compete, officiate, observe, work, or otherwise participate in any Velocity Rally track event or driving experience, or to enter any restricted area (any area requiring special authorization or otherwise closed to the general public), each participant, for themselves, their personal representatives, heirs, and next of kin:

● Acknowledges that they will inspect any restricted area they enter and will continue to do so throughout the event, and agrees that if at any time they believe conditions are unsafe, they will notify event officials immediately and, if necessary, leave the area or stop participating.

● Releases, waives, discharges, and covenants not to sue the event organizers, participants, sanctioning bodies, track owners and operators, officials, vehicle owners, drivers, crew, rescue and safety personnel, sponsors, advertisers, venue owners and lessors, inspectors, consultants, and all related parties (collectively, "Releasees") from all liability for any loss, damage, injury, or death arising out of or related to the event, whether or not caused by the negligence of the Releasees.

● Agrees to indemnify and hold harmless the Releasees from any loss, liability, damage, or cost arising from the participant's own injury or death, whether or not caused by the Releasees' negligence.

● Assumes full responsibility for any risk of bodily injury, death, or property damage arising from the event, whether or not caused by the Releasees' negligence.

● Acknowledges that the event activities are inherently dangerous and may result in serious injury, death, or property damage, and further acknowledges that injuries may be made worse by good-faith but imperfect rescue efforts.

● Agrees that this release extends to all acts of negligence by the Releasees, including in rescue operations, and is intended to be as broad as permitted under the laws of the jurisdiction where the event occurs; if any portion of this release is found invalid, the remainder will continue in full force.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY PARTICIPATING.

By registering and participating, I certify that I have read and understood all of the above, and I agree to be bound by these terms and conditions.
